Important risk warning and trading disclaimer
Last updated: Effective Date
By using Company Name ("StratOS", "we", "our", "us") products including the StratOS web app, StratOS Companion App, StratOS Trading Dashboard, Chrome extension, website at stratos-trading.com, and any related materials (collectively, the "Services"), you acknowledge and agree to the following.
Not financial advice
The Services are software tools for technical analysis, backtesting, and trade-routing only. We do not provide investment advice, financial advice, tax advice, trading recommendations, or any opinion about whether a specific trade, strategy, instrument, market, or course of action is suitable for you. The Services are not regulated under the Financial Services and Markets Act 2000 and we are not authorised by the Financial Conduct Authority.
You should consult a qualified, independent financial adviser before making any investment or trading decision.
You are responsible for your own trading decisions
All trades placed using the Services are placed by you, at your own discretion, with your own broker, using your own capital. We do not place trades on your behalf, hold custody of your funds, or have any access to your brokerage accounts beyond credentials you voluntarily configure within the software on your own machine.
You are solely responsible for:
- Choosing which strategies to run, on which instruments, in which market conditions
- Verifying that your broker, MetaTrader 5 setup, and account permissions allow the trades you are attempting
- Monitoring your positions and account state
- Complying with all applicable laws, tax obligations, and broker terms in your jurisdiction
- Any losses, missed opportunities, costs, or damages of any kind that result from your use of the Services
Risk of trading
Trading financial markets — including foreign exchange, contracts for difference (CFDs), cryptocurrencies, equities, futures, options, and any other instruments — carries a high risk of loss, and is not suitable for all investors. You can lose more than your initial deposit on leveraged instruments. The high degree of leverage available in derivative markets can work against you as well as for you.
Approximately 74-89% of retail investor accounts lose money when trading CFDs with major UK and EU providers (source: ESMA-mandated disclosures from authorised brokers). You should consider whether you understand how leveraged products work and whether you can afford to take the high risk of losing your money.
Past performance, backtests, and simulated results
The Services include features that produce backtest results, Monte Carlo simulations, walk-forward analyses, and "setfile" parameter sets that have been optimised against historical data. Hypothetical or simulated performance results have many inherent limitations, including but not limited to:
- They are prepared with the benefit of hindsight; the strategy parameters were chosen because they performed well on the historical data being shown
- They do not represent actual trading and therefore do not account for many real-world frictions (slippage, partial fills, gapping, broker outages, requotes, swap costs that may differ from those modelled, exchange holidays, regulatory changes, etc.)
- Past performance does not guarantee, indicate, or imply future results
- Strategies that performed well on historical data frequently underperform live, sometimes dramatically
You must not rely on backtest results, setfile metadata, or any other historical performance figure as a prediction of future returns.
The same applies to the live demo on our website and to any case study, research note or video we publish. These are hypothetical backtests, chosen to demonstrate the software.
AI-generated content
The Services include an AI assistant that can explain results, answer questions and build strategies. AI output can be wrong or incomplete, and it is not advice or a recommendation to trade. Figures shown in the Services are calculated by the backtest engine, not by the AI, but they remain hypothetical backtest results as described above.
No guarantees
The Services are provided "as is" and "as available". We make no warranty — express or implied — that:
- The Services will be uninterrupted, error-free, secure, or available at any particular time
- Trade signals will be delivered to your broker in any specific timeframe, or at all
- The optimiser, copy-trading engine, or webhook router will execute trades correctly under all market or network conditions
- Any provided strategy, indicator, setfile, or parameter set will be profitable
Software bugs, broker outages, network failures, server downtime, exchange halts, and unexpected market events can and will occur. You accept this risk in full.
Limitation of liability
To the maximum extent permitted by law, Company Name and its directors, officers, employees, contractors, and agents shall not be liable for any:
- Direct, indirect, incidental, special, consequential, exemplary, or punitive damages
- Loss of profits, revenue, opportunity, data, goodwill, or trading capital
- Personal injury, distress, or business interruption
…arising from or in connection with your use of, or inability to use, the Services — whether based on contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.
Our total cumulative liability to you for any and all claims arising under or in connection with these terms shall not exceed the greater of:
- The fees you have paid to us in the 12 months preceding the claim; or
